Here we go again.

In a week when David Letterman avoided an extortion trial involving his in-house affairs, when Tiger Woods is said to have hired Ari Fleischer to do damage control over his parade of mistresses, when the Eric Massa tale turned more serious with questions of seeking out young male staffers, Big Ben is in trouble — again.

The story broke last weekend that a college student had accused Pittsburgh Steelers quarterback Ben Roethlisberger of sexually assaulting her at a Georgia dance club. His agent put out a statement pooh-poohing the allegation and saying that “we are skeptical of motive.” All that happened was that “Ben and his friends met a group of women and everyone mingled together throughout the evening.”

Now it turns out there was more than just mingling.

“Ben Roethlisberger told police he did not have intercourse with a 20-year-old college student who has accused him of sexual assault, a Pittsburgh television station has reported.

“KDKA-TV, quoting anonymous sources, said the Steelers quarterback had ‘contact’ with the Georgia College and State University sophomore that ‘was not consummated’ and afterward she slipped and bumped her head.

Doesn’t sound like the kind of “contact” that happens when the offensive line hits you.

Now Roethlisberger is presumed innocent, of course. But I would point out that a Nevada resort hostess — who never called the cops — has sued him on charges of raping her during a 2008 golf tournament at Lake Tahoe. He has denied the charges.

Could that motorcycle accident while riding without a helmet have impaired his judgment?

No wonder Pittsburgh Post-Gazette columnist Ron Cook said of the 28-year-old: “It’s time he grows up. He’s no kid anymore. He needs to realize he’s not just representing himself in public settings but also his family, the Steelers and his teammates.”

Here’s the point: As a hugely successful football star, Roethlisberger must have women hanging on him all the time. Why can’t he pursue his love life without getting sacked by these accusations? Is this another Kobe situation? Does he, like Tiger, feel entitled to do whatever he wants, to play by a different set of rules, as Woods put it?

And isn’t this the same sort of thing we see in politics? Eliot Spitzer (Time chronicles his comeback attempt). John Ensign (the New York Times finds new evidence about his “efforts to steer lobbying work to the embittered husband of his former mistress”). John Edwards (who said political success fed “a self-focus, an egotism, a narcissism that leads you to believe that you can do whatever you want”).

As for Massa, this Washington Post story really changed the narrative:

“House Speaker Nancy Pelosi’s office was notified in October by then-Rep. Eric Massa’s top aide of concerns about the New York Democrat’s behavior, two congressional sources familiar with the matter said Wednesday night. Joe Racalto, Massa’s chief of staff, was uneasy that Massa, 50, was living with several young, unmarried male staffers and using sexually explicit language with them, one source said. But what finally prompted him to call Pelosi’s director of member services, the source said, was a lunch date that Massa made with a congressional aide in his 20s who worked in the office of Rep. Barney Frank (D-Mass.).”

The Larry King question kind of hangs in the air.

So how on earth did the ethics committee close its probe just because Massa quit — especially when it pursued the Mark Foley case after the Florida Republican resigned? Well, looks like the Democrats have bowed to pressure from John Boehner:

“The House voted 402 to 1 Thursday to send the ethics committee a GOP measure calling for an investigation into how Democratic leaders handled allegations of sexual misconduct by former Rep. Eric Massa (D-N.Y.).

“But a senior Democratic aide said the ethics committee never shut down its investigation of the Massa scandal in the first place — despite the fact that numerous sources familiar with the investigation told Politico, The Washington Post and other media outlets Wednesday that it had.”

At least some lawmakers, like the new guy with the pickup truck, are presumed clean. Uh-oh. “In 2000,” says Gawker, “Scott Brown was a freshman state representative in Massachusetts. A few years earlier, he’d served on the Wrentham, Mass. Board of Selectmen. Jennifer Firth, a local mortgage banker who was elected to the Board of Selectmen in 1999, filed a civil defamation suit against Brown in July of 2000, alleging that he had harassed her when she worked on his campaign in 1998, and then tried to smear her reputation around town with forged letters and emails.

“According to Firth’s complaint, Brown engaged in ‘offensive’ conduct that caused her to quit his campaign; he then tried to ‘defame and humiliate’ her by spreading rumors to her colleagues that she ‘had made sexual advances’ towards him during his campaign.”

But Firth soon withdrew the suit on her lawyer’s advice, undercutting the credibility of her claims.

By the way, it’s the New York Post that scored this scoop:

“Two sources in the golf community have told The Post that Ari Fleischer, the former presidential advisor to George W. Bush and the man who was brought in to help repair the steroid-shattered image of Mark McGwire, has been huddling with Woods, plotting a strategy for his return to golf — at the Arnold Palmer Invitational starting March 25 at Bay Hill in Orlando.”

If Ari could spin the Iraq war, no challenge is too great.

The AP, though, is saying this: “Tiger Woods intends to remain out of golf at least until the Masters, two people with knowledge of his plans told The Associated Press on Thursday.”

So much for bipartisanship

Seems to me that the Obama Democrats are now 0 for 3.

The stimulus package drew almost no Republican votes. The health-care bill drew almost no Republican votes. And now Chris Dodd has given up, as the NYT reports:

“The chairman of the Senate Banking Committee, hoping to break a months-long logjam on the biggest overhaul of financial regulations since the Depression, will unveil his own proposal on Monday, without yet having a single Republican endorsement. . . .

“The breakdown in bipartisan talks dimmed hopes for a sweeping rewrite of Wall Street’s rules, nearly two years after the collapse of the investment bank Bear Stearns started a financial crisis that has cost taxpayers hundreds of billions of dollars.”

Meanwhile, the Democratic-only path on health care may have gotten more complicated, as Jennifer Rubin sees it in Commentary:

“For a week or so now, Republicans and the conservative media have been hammering away on a procedural point, which is, in fact, vital to the whole reconciliation gambit being pushed by the Obama-Reid-Pelosi troika: the president will have a bill to sign once the House passes the Senate version, making any reconciliation process irrelevant and potentially moot if the Democrats then declare ‘victory’ and end the process. Thursday the Senate parliamentarian agreed:

“The Senate Parliamentarian has ruled that President Barack Obama must sign Congress’ original health care reform bill before the Senate can act on a companion reconciliation package, senior GOP sources said Thursday. The Senate Parliamentarian’s Office was responding to questions posed by the Republican leadership. The answers were provided verbally, sources said.

“So there you have it, House Democrats. Once you vote for the Senate bill, Obama will sign it, the Left will declare victory, and who knows if reconciliation will ever happen.”

Will Pelosi’s people really take the plunge on that basis?

Rahm rules

Behind the media fascination with the White House chief of staff is a curious fact, noted by Noam Scheiber in the New Republic:

“Allow me to posit a case study: Two high-ranking government officials are the subject of multiple newspaper and magazine profiles in the span of a few weeks. The first official resists the attention. He isn’t so much as quoted in any of the pieces, whose authors glumly note his lack of enthusiasm for their projects. By contrast, the second official goes out of his way to cooperate with the profile-writers. He submits to numerous, on-the-record interviews and mounts a detailed defense of his actions. His aides even distribute one of the articles after the fact.

“Now, which of these officials would you expect to be pilloried for hogging the spotlight and deflecting blame onto the president? Right–me, too.

“I refer of course to Rahm Emanuel and Tim Geithner. Since mid-February, Emanuel has seen his performance as White House chief of staff dissected in at least four pieces that were, to varying degrees, sympathetic: two in The Washington Post, one (by me) in this publication, and one in The New York Times Magazine. Similarly, Geithner’s tenure as Treasury secretary is the topic of thousands of words in the current issue of The Atlantic Monthly, The New Yorker, and Vogue. Emanuel is basically a ghost in his pieces. . . . Geithner is the central presence in his profiles, delivering lengthy soliloquies on the political economy of financial crises.

“But whereas Geithner’s participation is seen as benign, even salutary–virtually everyone in Washington (including me) thinks the administration could benefit from a better explanation of its economic successes–Emanuel’s studious non-participation is held up as evidence of malign intent. . . . It might all make perfect sense–if it weren’t completely nutso.”

Perhaps off-the-record is more suspicious than on-the-record, which doesn’t allow for any conspiracy theories.

Howell vs. Ailes

In a Washington Post Outlook piece, Howell Raines unloads on Fox:

“Why haven’t America’s old-school news organizations blown the whistle on Roger Ailes, chief of Fox News, for using the network to conduct a propaganda campaign against the Obama administration — a campaign without precedent in our modern political history?

“Through clever use of the Fox News Channel and its cadre of raucous commentators, Ailes has overturned standards of fairness and objectivity that have guided American print and broadcast journalists since World War II. Yet, many members of my profession seem to stand by in silence as Ailes tears up the rulebook that served this country well as we covered the major stories of the past three generations . . .

“My great fear, however, is that some journalists of my generation who once prided themselves on blowing whistles and afflicting the comfortable have also been intimidated by Fox’s financial power and expanding audience.”

Raines didn’t cite any specific stories, or attempt to address the difference between Fox’s opinion hosts and reporters. Maybe he sees no distinction, but would he have wanted the NYT’s news pages judged by the liberal editorial pages he used to head?

Every economist I admire, from Paul Krugman and Larry Summers on down, is convinced that inflation will remain low for as long as we can predict. Greg Mankiw, who was George W. Bush’s economic adviser, has examined the evidence in his New York Times column and concluded that a return of debilitating inflation is pretty unlikely. . . . Krugman has charged that inflation fearmongering is a nefarious Republican plot. The Congressional Budget Office (usually known by its nickname, ‘the nonpartisan Congressional Budget Office’) projects inflation rates of less than 2 percent for the next decade. Some say the real danger is the opposite: deflation, or prices (and wages) going down across the board.

“Maybe I’m like those generals who are always fighting the last war, but I am not reassured. I worry that when and if the recession is well and truly over, there is a serious danger of another round of vicious inflation. (If the recession is not over, or gets worse, we’ll have other problems.) This time, inflation will be a lot harder to stop before it turns into hyperinflation. Whether Obama navigates these shoals successfully will be a big factor in his historic reputation. And journalists will be kicking themselves (and other people will be kicking journalists) for missing a disaster story on the level of Hurricane Katrina, if not 9/11 itself. . .

“My specific concern is nothing original: it’s just the national debt. Yawn and turn the page here if you’d like. We talk now of trillions, not yesterday’s hundreds of billions. It’s not Obama’s fault. He did what he had to do. However, Obama is president, and Democrats do control Congress. So it’s their responsibility, even if it’s not their fault.”

But inflation remains a distant danger for politicians who don’t like to inflict pain, as we’ve seen all too starkly in the health-care debate. So the forecast is for more of the same.

L’Affaire de Carla

And if le marriage somehow survives? Well, that doesn’t sound like much of a story.

Australian navy faces inquiry in alleged sex ring

SYDNEY — Australian officials have launched an investigation into allegations that sailors on board a navy ship were running a sex competition during an overseas deployment last year.

The Defense Department says the inquiry that began Friday comes after an initial investigation was found to be biased.

Three sailors from the HMAS Success were sent home last May after reports emerged that sailors were competing to have sex with the most number of female crew mates. The investigation will look into allegations that dollar values were assigned to each woman on board and that sailors could win extra money if they had sex with a female officer or a lesbian.

The new inquiry is to be led by a retired judge.

Porn bills were likely motive for slaying of Adelanto mother, authorities say

Investigators say an Adelanto man may have decided to kill his mother after they appeared together on a “Judge Mathis” television show where he was ordered to repay his mom part of the money he ran up in bills for pornography.Atraybion Charles Harmon, 20, has pleaded not guilty to stabbing his mother to death March 4 in the family’s home in the 11300 block of Essex Court.

In February, 55-year-old Barbette Harmon took the eldest of her three sons on the “Judge Mathis” show to recoup costs she claimed Atraybion Harmon racked up on Internet and television porn.

Judge Mathis ruled in her favor, ordering Atraybion Harmon to pay $5,000. On the television show, the judgement is actually paid by the production company.

Nevertheless, detectives believe the appearance on the show was the motive for Barbette Harmon’s slaying.

“It did play a role,” said San Bernardino County sheriff’s homicide Detective Steve Pennington. “He didn’t pay anything out of his pocket but he still owed quite a bit of money to her.”

A YouTube video with a clip from the episode was posted three weeks ago but is no longer available for viewing. Warner Bros. Entertainment has put up a label saying it was taken down because of a copyright claim.

Officials with the show declined to comment.

Sheriff’s deputies were called to the family’s home about 1:20 p.m. when Atraybion Harmon called 9-1-1 to report that he had come home and found his injured

mother. Paramedics pronounced her dead at the scene.Atraybion Harmon lived in the home with his mother and two younger brothers, neither of whom were home at the time of the attack, authorities said.

Investigators have said they found evidence at the scene that led them to believe Atraybion Harmon was involved but they declined to say what the evidence was.

“We became suspicious of what we found at the scene,” Pennington said. “His story didn’t match up.”

Harmon is being held without bail at West Valley Detention Center in Rancho Cucamonga. He is scheduled to appear Thursday in Victorville Superior Court.

It has been reported that the model, who presently works as a make-up artist, became furious when she came to know that the filmmakers had used one of her bikini photographs in an indecent manner in the movie. It has been reported that she did not have any idea about the use of her photograph in the film, until her clients told her that they could recognize her from the photograph in the film.

Irina Krupnik, who did not have any information about the use of her photograph in the movie, “Couples Retreat” was shocked with the act of the filmmaker. According to the reports, she had never sold her photograph to the makers of “Couples Retreat” and they did not have any legal right to use her photograph in the movie. It appeared that the former model has been extremely annoyed with the filmmakers and has accused Universal Pictures Co. and NBC Universal for tampering her “wholesome image”. Reports indicated that the model has also accused that the usage of her image appeared to be “shocking” and “tawdry” to her.

The reports indicated that the model, Irina Krupnik, who has been disappointed to see the usage of her photograph in the movie, had filed a legal suit claiming ten million dollars for using her photograph without acquiring the legal rights. Though the model has been quite vocal against the filmmakers, they have not yet made any comments regarding the allegation.

Lawmakers Say “Sexters” Aren’t Porn Peddlers

Some lawmakers don’t think teens who are caught “sexting” deserve child pornography charges.

The Illinois House Thursday voted 114 – 1 against convicting teen “sexters” as kiddie porn peddlers, thus sparing them having to register as sex offenders, the Sun-Times reports.

The rules would ease stiff penalties against unwitting photo collectors.

But that doesn’t mean they want to completely let teens off the hook if they’re caught passing around naked pictures of other teens.

“We still have the ability to prosecute those whose intent is to create child pornography even if they’re under 18,” says Representative Darlene Senger (R-Naperville) who is sponsoring a measure that would punish teen violators with softer penalties like community service or court-ordered supervision. “However, if you’re just doing something because you think it’s a prank, we can explain why this isn’t funny.”

Senger says the problem is kids are just not aware that when they engage in “sexting” or sending naked pictures of themselves to a boyfriend or girlfriend, that picture may get passed around to others or that laws are being broken, according to the Sun-Times.

“The goal of this legislation is creating awareness,” she said. “Parents are very concerned with what’s going on with cell phone cameras. Kids are being bullied. Girls are committing suicide because of what’s going on.”

ICANN delays .xxx porn domain

ICANN has delayed the introduction of .xxx again, despite a ruling that the porn-only Internet domain should have been launched five years ago.

The board of the Internet policy body voted this morning to push a firm decision on the controversial domain at least three months into the future. Realistically, it will take longer.

Two weeks ago, an independent panel of judges found that ICANN broke its own rules when it approved, then subsequently rejected, an application to run .xxx by Florida-based ICM Registry in 2005.

ICM claims the reversal came as a direct result of pressure from the US government, under the Bush administration, which had been lobbied hard by the religious right. ICANN denied this, claiming it changed its mind because ICM couldn’t show backing from the porn industry.

Today, the board was asked to vote on how to deal with the review panel’s findings.

Rather than deciding to return to contract talks with ICM, the board decided that the .xxx application needs re-approving, and realised that it no longer has a procedure to handle the application.

The resolution reads: “in the absence of a process for approving an sTLD six years following the receipt of the original application, the Board wishes to create a transparent set of process options which can be published for public comment”.

The board voted to give ICANN staffers two weeks to come up with some ideas about possible processes. These will be posted for public comment for 45 days, then the board will vote on which process to use at its next public meeting, set for Brussels in late June.

ICM had taken a hard line prior to the board meeting, but accepted its decision. President Stuart Lawley told us today that the company is “looking forward to seeing the proposals in the next 14 days”.

Stripper mobile grinds to a halt

Fans call it a brilliant marketing tool and a symbol of free speech.

Naysayers call it a skank tank and an accident waiting to happen.

Love it or hate it, the stripper mobile created a buzz recently when it cruised Tampa party zones with not-quite-nude dancers bumping and grinding around a pole.

That ended a few weeks ago when police put the brakes on the roving billboard for Deja Vu, a nationwide strip-club chain with a location on Adamo Drive. Local authorities said there was a problem with the vehicle’s registration out of Nevada.

Fix it or else.

Deja Vu officials in Tampa and Las Vegas have been working on the issue but, so far, haven’t been able to resolve it. Once it is, the truck will get back on the road, said Eric “Ice” Terrell, general manager of the Tampa club. He hoped that would happen this weekend or next.

The stripper mobile rolled through Ybor City, Channelside and SoHo on weekends from 10 p.m. to 2 a.m. It looks like a delivery truck with see-through sides and a dance pole in the back.

Not surprising in a town known for its strip clubs and lap dances, the vehicle got a lot of notice and boosted business, Terrell said. The club’s lawyer, Luke Lirot, said it didn’t break the law because the dancers wore bikinis.

“I don’t think it ever violated decency rules,” said Lirot, a First Amendment lawyer well-known for representing Mons Venus strip club owner Joe Redner. “It’s simply a marketing tool. It’s not meant to offend.”

The stripper mobile began in Sin City last fall, cruising the strip to draw business to the Las Vegas Deja Vu. Then a county commissioner caught wind of it and vowed to shut it down, claiming it was unsafe and unseemly.

Rather than engage in a costly fight, club officials decided to be “good citizens” and parked the truck. They also didn’t want to inflame lawmakers who approve the club’s permits and licenses.

In Tampa, camps have lined up on both sides.

A recent discussion on Momslike me.com, a site for sharing advice and stories, drew plenty of criticism from moms concerned about safety and the message the stripper mobile sends to children.

“As if worrying about drunk drivers isn’t bad enough, let’s throw a Plexiglass bus full of scantily clad girls on a stripper pole … and see how many accidents this causes,” said one anonymous mom.

Others say the truck was unfairly targeted. Radio station 98Rock started an online petition, freethestripperbus.com, which has about 145 signatures.

“C’mon, it’s a harmless vehicle that travels in the entertainment district after 10 p.m.” posted one petitioner. “Who wouldn’t want to see that?”

Sex industry fears .xxx porn ‘ghetto’

The adult industry is up in arms over a renewed push for a “.xxx” domain name, which they fear would be the first step towards segregating porn sites into a “ghetto”.

Proponents believe the new .xxx domain would create an online red-light district where porn sites can set up shop away from the wandering eyes of children and teenagers.

Parents would be able to use the system to help block access to porn sites, though because its use would be voluntary, the “.xxx” suffix wouldn’t keep such content entirely away from minors. Religious and other anti-porn groups worry that “.xxx” would legitimise porn sites, and the proposal has already been rejected three times since 2000.

But the Internet Corporation for Assigned Names and Numbers, which oversees the allocation of internet addresses globally, may revive ICM Registry LLC’s bid yet again as ICANN meets this week in the Kenyan capital of Nairobi.

Last month, responding to complaints from ICM, an outside panel questioned ICANN’s grounds for the latest rejection in 2007. As a result, board members have been weighing the matter ahead of formal consideration of the “.xxx” bid on Friday, ICANN CEO Rod Beckstrom said in an interview.

Australian Sex Party convener Fiona Patten said the entire porn industry was against a .xxx suffix, saying they would be extremely reluctant to give up their .com sites in favour of moving to the .xxx “ghetto”. She feared the entire .xxx domain could be blocked by the Government’s internet filters in future.

A spokesman for Communications Minister Stephen Conroy said the Government did not support the introduction of a .xxx top-level domain.

“I don’t think it’s got anything to offer … except that [for example] Hustler.com’s now got to buy Hustler.xxx to protect our trademarks and protect our names,” Patten said.

Beckstrom said he was not able to give details of those discussions for legal reasons, and he could not say when ICANN may reach a decision.

Stuart Lawley, ICM’s chief executive, said he has been the victim of a process that he considered far from open and nondiscriminatory.

ICM, which planned to charge $US60 for a site to register a “.xxx” name, first proposed “.xxx” in 2000 as a way to help the online porn industry clean up its act. Those using the domain would have to abide by yet-to-be-written rules designed to bar such trickery as spamming and malicious scripts.

And parents could set up internet software to automatically block any site ending in “.xxx,” reducing the chances that minors and other internet users would accidentally stumble on pornography online.

Given its voluntary nature, however, “.xxx” would unlikely have much effect on parents’ ability to block porn sites. And because a domain name serves merely as an easy-to-remember moniker for a site’s actual numeric internet address, even if its use is required, a child could simply punch in the numeric address of any blocked “.xxx” name.

“I can only see this as a money-making venture for ICM,” Patten said.

Anti-porn activists, meanwhile, worry that the creation of a virtual red-light district would serve as an endorsement of the adult-entertainment industry, as “.xxx” would be sitting alongside other suffixes such as “.com” for commercial sites and “.edu” for schools.

Skeptics note that porn sites would likely keep their existing “.com” storefronts, even as they set up shop in the new “.xxx” domain name, thereby expanding the number of porn sites on the internet.

When ICANN last considered “.xxx,” board members also expressed worries that the suffix would leave the agency in the business of regulating content, or the type of material that would find itself there.

The board also questioned whether “.xxx” had the support of the adult-entertainment industry, as many operators of porn sites were concerned that governments would later make the voluntary red-light district mandatory.

ICANN still wasn’t swayed after ICM said that the content-regulation role would have been left solely with the company and that ICM would fend off efforts to mandate its use.

Lawley challenged ICANN’s rejection before an independent review panel appointed by the International Centre for Dispute Resolution. That panel largely sided with him and concluded that ICANN’s decision was “not consistent with the application of neutral, objective and fair documented policy.”

The panel said that after ICANN gave the bid preliminary approval in 2005, it shouldn’t have revisited some of the key issues already reviewed. Board members had used the new evaluations in deciding to reject the bid two years later, in 2007.

Although the panel’s findings are nonbinding, ICANN’s board was scheduled to discuss them Friday. It was not clear whether the board would vote on the matter or defer a decision for more discussion.

Lawley said the review panel was supposed to be ICANN’s mechanism for accountability, and how the organization responds to the panel’s findings “will provide great insight into the true accountability of this vital organization.”

He said the process has so far cost his company about $US8.5 million.

ICANN tabled and effectively rejected a similar proposal in 2000 out of fear the “.xxx” domain would force the body into content regulation.

ICM resubmitted its proposal in 2004, this time structuring it with a policy-setting organization to free ICANN of that task. But many board members worried that the language of a proposed contract was vague and could kick the task back to ICANN. The board rejected the 2004 proposal in 2006.

ICANN revived the proposal months later after ICM agreed to hire independent organizations to monitor porn sites’ compliance with the new rules. But ICANN ultimately rejected that bid in what was to be its final.

Federal court says Nevada can limit brothel ads

LAS VEGAS — A federal appeals court on Thursday upheld a Nevada law that bars legal brothels that operate in some of the state’s rural areas from advertising by newspaper, leaflets and billboards in Las Vegas, Reno and other places where prostitution is illegal.

Nevada Attorney General Catherine Cortez Masto hailed the ruling by the 9th U.S. Circuit Court of Appeals panel in San Francisco, while a lawyer for the American Civil Liberties Union of Nevada promised to appeal.

The laws had been challenged by the ACLU, a Nye County brothel called the Shady Lady Ranch and two newspapers: the High Desert Advocate and Las Vegas City Life.

Prostitution is illegal in Clark and Washoe counties — which include Las Vegas and Reno — and three other Nevada counties. Ten Nevada counties authorize prostitution by local ordinance.

The 9th Circuit panel reversed a ruling by U.S. District Court Judge James Mahan in Nevada that two 1979 state laws prohibiting brothel advertising in counties where prostitution is illegal were overly broad and unconstitutional.

The laws also prohibit brothel advertising in theaters and on streets and public highways.

The 9th Circuit noted in its ruling that Nevada was unique among states because it has a “nuanced boundary,” rather than total criminalization of prostitution.

But the state still seeks to confine the sale of sex acts through licensing and advertising restrictions, the judges said.

“The Nevada laws appropriately limited commercial speech,” the 9th Circuit said. “We conclude that the interest in preventing the commodification of sex is substantial.”

ACLU attorney Allen Lichtenstein said he didn’t immediately know whether he’d seek a hearing before the full 9th Circuit or would ask the U.S. Supreme Court to take the case.

“The key issue is freedom of speech,” he said.

It’s a violation of the First Amendment for the state to restrict advertising by a legal industry, and it’s wrong for a court to make exceptions because the state doesn’t want to have it advertised that legalized prostitution exists, Lichtenstein said.

Masto called free speech “perhaps our most cherished right.” But Nevada has had restrictions on brothel advertising for 40 years, and the state should have the right to have reasonable limitations, she said.

“The circuit’s decision proves there are different ways to deal with the issue without trampling on First Amendment rights,” she said.

Bobbi Davis, owner of the Shady Lady Ranch, declined immediate comment.

George Flint, a lobbyist with the Nevada Brothel Owners Association, said he hadn’t seen much advertising by the 24 legal brothels around the state, and didn’t think the court ruling would have much effect.

“We’ve encouraged our people to be cautious and not get carried away,” Flint said. “The Legislature may not be able to control the advertising issue, but they do control our destiny.”

The case is Coyote Publishing v. Miller, No. 07-16633.

The woman who went to prison for running a high-priced prostitution ring is out of jail and says she is a reformed woman.

Sallie Saxon served two years behind bars and remains under supervised release. She was interviewed Monday by the Observer’s news partner, WCNC-TV, at First Baptist Church, which she says has become a home for her.

“I always wanted other people to respect me. That doesn’t matter to me anymore,” Saxon said.

For the last five months, Saxon has been in a halfway house in Charlotte. She was released last week.

Saxon ran Hush Hush, an Internet escort service with a clientele list that stretched from the Carolinas to Washington.

She said she never thought she would be arrested. “I thought I was above that. I thought all I had to do was pick up the telephone and it would be handled for me and I would never go anywhere,” Saxon said.

But in November 2007, FBI agents knocked on her door and arrested her for running a multimillion-dollar prostitution ring.

“I knew it was real when they put the shackles on,” she said. “That’s very humiliating.”

That’s when she said she decided to become a Christian.

Now, her goal is to minister to others who might need help - “offer encouragement, hope that it doesn’t matter what you have done or how bad you have been. There is hope.”

Turns out, former “Bachelor” contestant Rozlyn Papa did not star in a sex tape after all.

A 15-second video featuring a Papa look-a-like engaged in various sex acts with a well endowed gentleman was posted to Pornhub.com on Tuesday. But Lexington Steele, the man in the tape, told E! Online that this partner at the time was not the 29-year-old Papa.

“I feel for Rozlyn, because that is not her,” Steele said. “The girl in the video is from the Czech Republic, all of the girls in this release were shot on location in Prague. That girl has never traveled to the United States of America.”

Stacie Vanchieri, Papa’s rep, has always denied that his client starred in the tape.

“I’ve seen the tape,” Vanchieri told E! “Anyone who has met her once would know it’s not her. The woman has a different body, hands, face, everything.”

And Steele’s claims seem to lay the rumor to rest once and for all.

Of course, this isn’t the first scandal to hit Papa recently.

The model-actress was kicked off the most recent season of “The Bachelor” after a supposed affair with a married producer.

She then appeared on a “Bachelor” post-season special and quipped that host Chris Harrison, who is married, hit on a producer’s wife in New Zealand.

The 38-year-old host responded, “I won’t dignify that with a response. I hope you will become a better person through this.”

A companion of late Playboy model Anna Nicole Smith can sue an author for defamation but not over gay sex claims because homosexuality is no longer viewed as contemptible, a U.S. judge said Wednesday.

Howard K. Stern is suing Rita Cosby and the Hachette Book Group over Cosby’s bestseller Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death.

Stern is the former lawyer and boyfriend of Smith, the Playboy playmate and Guess jeans model who died in 2007 from a prescription drug overdose.

Stern claimed the book, which was published six months after Smith’s death, contained 19 libelous statements, including that he had engaged in oral sex at a Los Angeles party with Larry Birkhead, the father of Smith’s child, and that Smith had later called Stern gay.

U.S. District Judge Denny Chin ruled the defamation case could proceed on 11 of the statements.

Chin dismissed Stern’s claims that statements implying he was homosexual were defamatory, although he acknowledged that gays and lesbians still suffered prejudice.

“I respectfully disagree that the existence of this continued prejudice leads to the conclusion that there is a widespread view of gays and lesbians as contemptible and disgraceful,” the judge said.

Chin ruled that Hachette could not be sued because it had no reason to doubt the truth of the book. But he noted Cosby, who is also a television reporter, had to answer to claims that she knew some of her sources were not truthful.

Court blocks Hustler from getting slain coed photos

A DeKalb County Superior Court judge this afternoon issued a temporary restraining order that bars the Georgia Bureau of Investigation from releasing crime scene photos of slain hiker Meredith Emerson to Hustler magazine.

Emerson’s family sued the GBI on Tuesday, asking for an order to prevent authorities from releasing the photos to protect the privacy of the slain University of Georgia graduate.

Emerson, 24, who lived in Buford and worked in Winder, was abducted Jan. 1, 2008, while hiking with her dog near Blood Mountain in North Georgia.

Gary Michael Hilton, a drifter with a record of petty crimes, held her captive for three days before beating her to death. Hilton pleaded guilty to the murder and received a life sentence for the crime, and is awaiting trial for a similar crime in Florida.

State lawmakers and law enforcement officers have condemned Hustler’s Open Records Act request for photos of Emerson’s decapitated body.

The Meredith Emerson Privacy Act, which would bar law enforcement agencies from releasing such photos in the future, is pending in the state General Assembly.

Roethlisberger Admits Sexual “Contact”

Ben Roethlisberger admitted to police he had sexual contact with a woman accusing him of sexual assault at an Atlanta-area nightclub Friday night, but denies the two had intercourse, according to sources speaking to CBS Pittsburgh station KDKA.

After the woman made the claim, police in Milledgeville, Ga. spoke with the two-time Super Bowl-winning Steelers quarterback, the station reports. And, notes CBS News Correspondent Jeff Glor, those investigators say they intend to interview Roethlisberger again in coming days.

He was at the club celebrating his 28th birthday.

The sources also say Roethlisberger denied there was an assault, and told cops the woman, 20, slipped and fell after the sexual contact, injuring her head.

The woman immediately went to a local hospital to report her complaint, Glor points out.

Police will ask Roethlisberger for DNA samples, Glor says, presumably to see if they match substances taken from the woman at the hospital.

Roethlisberger’s lawyer, Ed Garland, maintains his client will emerge from the incident with his reputation intact. “We intend to finish this case in a way that neither his liberty nor his future is damaged,” garland told reporters.

Roethlisberger is also being sued by a woman who claims he raped her at a Lake Tahoe hotel/casino last year, an allegation he strongly denies.

Club Space Offers Reward To Catch Model’s Killer

The murder of a model in South Florida, seen on airwaves across the nation on America’s Most Wanted, is getting a boost in reward money.

Club Space, the night club where 26-year-old Paula Sladewski was last seen, is offering $15,000 as part of the reward to catch her killer.

There are very little clues in the death of the pretty young woman. She was last seen leaving Club Space at 7:30 am on January 3rd. Her body was found burning in a dumpster that same day in North Miami. The surveillance video shows her leaving with a man.

Kevin Klym, Sladewski’s boyfriend who was kicked out of the club for arguing with her, has been in town passing out flyers and looking for tips. He believes the man in the suspect sketch may be the club bouncer who threw him out after the couple got into a fight.

Klym’s private investigator went on to say the staff at Club Space has changed, but the club’s owner and a spokesman denied those allegations.

“That is flat out inaccurate and it’s a reckless accusation,” said spokesman Jeff Garcia. Owner Luis Puig said, “He’s welcome to come out and try to identify one of our employees, they’re on payroll and they are on camera. They’re actually on camera escorting him out for physically abusing his girlfriend.”

Investigators say Klym is still a person of interest.

Urinal Based On President Bush Draws Controversy

More than 90 years after Marcel Duchamp famously presented a urinal as a work of art, the trend continues – and continues to draw controversy.

This time, the fuss is about a urinal sculpted in the likeness of former President George W. Bush.

Sculptor Clark Sorensen produces handmade, homemade pieces in his studio/garage in the Mission District section of San Francisco.

“It started kind of as a joke,” said Sorensen. “I was working in porcelain, and I thought, ‘what can I do with a urinal?’”

He has produced urinals in the shape of orchids, lilies and morning glories. But the design that has people talking is “George W. Flush,” a likeness of former President Bush with an oversized head and a wide open mouth.

In comments on a story on cbsnews.com, the Bush urinal drew strong reaction.

“This is in poor taste and disrespectful no matter your opinion. What has happened to civilization? Why is everyone so filled with hate?” one poster wrote.

“Inappropriate no matter if you hate guy or not,” another poster wrote. “This is going down a bad path.”

But not all the comment posters disapproved.

“Here here! Right on! Well said! Dead on! Yet an ugly mental image,” one comment read.

The urinal also drew strong reaction on Monsters & Money in the Morning.

“What if somebody invented one about Obama? Would it be hanging in a San Francisco toilet?” said co-host Mike North. “I would say no.”

The one-of-a-kind urinal is not installed in any men’s room. It is on display at a gallery art show in San Francisco.

Sorensen has also designed a urinal that is painted to show the stock market going down the drain, and another one that reads “The World According to Bush” and displays the continents swirling into the drain holes.

Creativity in restroom fixture design has drawn complaints and controversy on plenty of other occasions.

In 2004, Virgin Atlantic Airlines was planning to install bright red urinals shaped like mouths at its business class terminal at John F. Kennedy International Airport in New York City. But the plans were scrapped after a flurry of complaints, according to published reports. Two years later, a McDonald’s in the Netherlands removed urinals of the same design in its men’s room after a tourist complained.

Meilke van Schijndel is the Dutch designer who created the urinals, titled “Kisses.” She said they were supposed to represent silly cartoon mouths, and not women’s mouths as some had concluded, according to the Web site Expatica.com.

In another case in Changchun City, China, a restaurant was widely criticized for keeping live ornamental fish in the trough urinal in its men’s room.

As for Sorensen, he tells CBS 2 sister station KPIX-TV that he sells pieces around the world, not so much in the United States.

“The U.S. might be a little uptight compared to Europe. I think you have to have a good sense of humor. I don’t know why. That’s my theory,” said Sorensen.

He also has a whole line of sinks, and the moment he’s flushed with success.

Man hired by divorce-seeking husband to seduce wife gets 15 years for her murder

A private detective hired by a divorce-seeking husband to seduce his wife has been sentenced to 15 years in prison for strangling the woman.

Prosecutors demanded 17 years’ imprisonment for Takeshi Kuwahara, 31, an employee of a private detective agency at the time of the crime, accusing him of murdering Rie Isohata, 32, on April 12, 2009, after the victim found out that her husband and Kuwahara had worked together to plot her divorce.

Kuwahara was allegedly hired by the victim’s husband, who was seeking a divorce from the woman, as a “couple buster” in 2007. He falsified his identity and seduced the woman to encourage her to divorce her husband. Their relationship continued after the woman divorced her husband, however, after she found out that Kuwahara had a wife and children and that she was set up by the two men, the victim became enraged. Kuwahara reportedly strangled the woman during an argument.

“The defendant cannot escape blame for his immoral action,” said Presiding Judge Yoshimitsu Goda during the ruling at the Tokyo District Court on Tuesday. “His motive was shortsighted and selfish,” he added.

The victim’s 61-year-old father said the sentence was too lenient. “Fifteen years is too short, and I can never forgive him. The couple busting business represents the social distortions of today. There should be regulations to control it.”

Currently, there are no regulations to control such businesses in the country, but some 380 member agencies of the Nihon Chosa-gyo Kyokai (Japan Association of Detective Agencies) nationwide have self-imposed rules banning any activities that disrupts marriages, according to the organization. The employer of Kuwahara, however, did not belong to the association.

Lee Jin-gyu fell for his ‘dakimakura’ - a kind of large, huggable pillow from Japan, often with a picture of a popular anime character printed on the side.

In Lee’s case, his beloved pillow has an image of Fate Testarossa, from the ‘magical girl’ anime series Mahou Shoujo Lyrical Nanoha.

Now the 28-year-old otaku (a Japanese term that roughly translates to somewhere between ‘obsessive’ and ‘nerd’) has wed the pillow in a special ceremony, after fitting it out with a wedding dress for the service in front of a local priest. Their nuptials were eagerly chronicled by the local media.

‘He is completely obsessed with this pillow and takes it everywhere,’ said one friend.

‘They go out to the park or the funfair where it will go on all the rides with him. Then when he goes out to eat he takes it with him and it gets its own seat and its own meal,’ they added.

The pillow marriage is not the first similarly-themed unusual marriage in recent times - it comes after a Japanese otaku married his virtual girlfriend Nene Anegasaki, a character who only exists in the Nintendo DS game Love Plus, last November.

An award-winning female porn director has been appointed as a parliamentary hopeful for the Liberal Democrats, it was disclosed today.

Anna Arrowsmith - managing director of adult entertainment company Easy on the Eye Productions - will stand for election in Gravesham, Kent.

Mrs Arrowsmith, who works under the pseudonym Anna Span, started shooting porn films after graduating from Central St Martins in Fine Art (Film & Video) in 1998.

Since then she has directed more than 250 raunchy scenes, and written and photographed a book to guide couples in how to make home-made porn.

Today, the 38-year-old, who is married and lives with her husband Tim and dogs in Groombridge, near Tunbridge Wells, insisted she was ready to win Tory Adam Holloway’s seat at the general election.

Mrs Arrowsmith, who also has an MA in philosophy, said she was spurred into standing for election by the MPs’ expenses scandal and a belief that women are under-represented in Parliament.

She said: “If people don’t know what I do for a living then they would never know. The local party and the local people who I have so far met have seen that I’m very driven.

“I’m not campaigning on behalf of my old industry. I’m campaigning on behalf of the people in the Gravesham area.

“When people get to see me, they will realise that I’m used to project managing and that I’m driven to achieve change rather than just promising it.”

Her interest in politics stemmed from her watching Margaret Thatcher during the 1979 general election campaign and willing her to become Britain’s first female prime minister.

Mrs Arrowsmith, who was named best director in the 2008 and 2009 UK Adult Film and Television Awards, became involved in porn to make it more accessible to women, she said.

Her first commercially-released programme was on Television X, titled Eat Me/Keep Me, which led to further X-rated shows and her becoming chair of the Adult Industry Trade Association.

On her Twitter site, where she has more than 420 followers, she wrote: “From the adult industry! From porn to Parliament, here I come!”

Describing herself as a keen campaigner for women’s rights and anti-censorship issues, she said she has spent 12 years trying to make the adult industry more female-friendly.

A Liberal Democrat spokesman said: “The Liberal Democrats are proud to have candidates throughout the country with a great diversity of backgrounds and life experiences.

“Anna will be a strong candidate for Gravesham, and with her family links to the area we believe she is the best person to bring fairness to local people.”

Pornstar Ricky Sinz’s blog: A fascinating portrait of a sensitive man

I love pornstar blogs. Well, when they are interesting. And I love big tattoo-covered muscle guys who do porn. Like Ricky Sinz.

Sinz, it turns out, is not “just” a big tattoo-covered muscle pornstar. I learned this from reading his blog. Unzipped magazine issues awards for pornstar blogs, and Sinz’s Hardcore Hangout was honoured as porn’s Most Frightening Blog last year, specifically for a post about how he killed a dog.

But when I went to that post, I didn’t find it frightening at all. The guy served in Iraq for three years; he has gone on record as saying he killed 28 people. Killing a pit bull to defend his six-year-old nephew? That just makes sense. Good for him for having the skill set to do it.

Sinz is an army guy. He was a Special Forces soldier at age 25. He was involved in combat at Fallujah, which permanently disabled him. He challenged the US’s Don’t Ask, Don’t Tell policy publicly, then did a gay military-themed adult movie. The army was not impressed; he says it dropped him in rank and refused to give him disability. “Treated me like a piece of garbage, and now they want to deploy me again,” he says.

Sinz is also a DJ. I downloaded all his sets and was blown away. Not just by the mixing, which is great, but by the versatility. According to his blog, he is well respected in the Chicago house scene, having been involved at a young age, pre-military and pre-porn. When he returned from service, he got back into it, using his porn persona to help publicize his DJ persona.

Sinz is bisexual. He addresses this openly in his blog because he also does some straight porn, and he knew he would be getting the “gay for pay” commentary from the masses.

When you read enough posts, you can see he is a sweet guy with a sense of justice. And he is a very interesting entrepreneur and a total individual. He clearly does not give a fuck what anybody thinks about him.

Study shows how downloaders skirt anti-piracy laws

The credibility of France’s controversial anti-piracy law (known in France as “Hadopi”) has taken a dive after a study revealed that its main effects were to educate illegal downloaders in new ways of viewing copyrighted material for free.

Marsouin, a Brittany-based network of specialist research centres which interviewed 2,000 Internet users, yesterday published a damning report claiming that Hadopi is divorced from reality, overly repressive and has the opposite effects of those it sets out to achieve.

“By putting the stress on illegal ‘peer-to-peer’ file sharing, Hadopi has pushed pirates to find other ways of downloading copyrighted material that does not fall within the bounds of this French law,” says Marsouin project coordinator Sylvain Dejean.

Dejean points out that while the number of peer-to-peer downloads has fallen by 15% since the law was introduced last year, the number of songs, films and software packages illegally downloaded has gone up by 3%.

Streaming and direct download

Video streaming is the number one beneficiary of the shift away from file sharing. Streaming involves seeing or listening to material broadcast “live” through often advertising-heavy websites.

Direct download sites (which often levy a small charge), such as Megaupload or Rapidshare, allow data to be downloaded directly, and thus do not fall under the “file sharing” bracket that is the main influence of the Hadopi law.

“Streaming is especially popular for watching TV series,” says Dejean, “while direct download is more popular for downloading whole films.”

Punishing consumers

Hadopi also threatens the huge market in legal paid-for downloads in allowing persistent offenders to have their Internet connections cut.

Dejean points out that many of the people interviewed in the poll said that while they did indulge in some illicit online activities, most also actively spend their money on products or services purchased online.

He goes so far as to suggest that if all illegal downloaders in France were “cut off”, it would knock 25% off the legitimate Internet market. “If the main intention of this law is to give a boost to legal downloads, there is a big risk it could prove extremely counter-productive,” he said.

Finally, Dejean anticipates a big growth in virtually untraceable newsgroup membership and use of virtual servers for finding copyrighted material. These groups may cost a few euros a months to join, but that is much less than paying through legal downloading sites.

And I have no idea why he won’t man-up to having a chick. Kinda weird if you ask me.

Anyway, I’m shooting BTS, and the first question I ask is, “tell everyone at home your real name.”

“Jane Doe,” she said.

Any time a porno chick gives up her real name during BTS (or shooting the scene), you know you’ve got a first-timer on your hands.

I stop camera. “Um, Jane, you don’t want to use your real name. I mean there’s nothing wrong with using your real name as your porno name if you want. Dana DeArmond and Julia Bond are perfect examples. Remember, use your stage name. I’ll start over.”

“But I don’t have a stage name.”

I love giving girls stage names. Off the top of my head, I’ve named BJ Swallows, Anna Von Trapp, Kimmy (I know…boring), Keesha Knight — and now I get a shot at Jane Doe.

This is a serious thinking process. One I don’t take lightly. And fuck the Name-Your-First-Pet-and-Street-You-Lived-On-When-You-Were-A-Kid process…although that can work out rather nicely (the process used for Keesha Knight).

My porno name would be Dino Birch. If I could add about 3 more inches to my ween, I’d be Dino Birch, and I’d be painting the town white.

But I’m not.

I looked at Jane Doe and thought hard: “You’re so mid-west…and I hate to say this…so girl-next-door, I’d really, really say you need to have a name that matches your look. For example, when I blog this story, I’m gonna call you “Jane Doe”, cause I won’t use your real name. But that’s your look. Total Jane Doe. Which isn’t a bad thing at all. It’s really good if you ask me. I like to watch girls you’d never think do porn, doing porn. You know? The whole bleach-blonde fake titty tatted up girl that’s gone though lipo and had her teeth veneered and her hair isn’t really her hair but it’s a weave is so dumb…if you ask me, of course.”

By the way, this was going through my head. What I just wrote. About Jane Doe and Jon Dough and then John Doe and then punk rock and how much I loved to catch X play back in the day and how much I like punk rock and how much I miss how new and raw punk used to be and how it is no longer…and then…suddenly…it hit.

“Janie Jones!”

Janie Jones looked at me. I looked at her.

Closely. “Yes. That’s a perfect name! Your new name is Janie Jones!”
