TAMPA — Tensions ran high Friday in the federal obscenity trial of a pornographer, with defense attorneys accusing the judge of favoring the prosecution and asking that she recuse herself or declare a mistrial.

Defense attorneys complained that U.S. District Judge Susan C. Bucklew didn’t allow them to question a juror who sent a note Thursday asking to watch less pornography in court. They wanted to know if the note represented only his views or if he had discussed the case with other jurors.

The defense also accused the judge of unfairly questioning why they insisted on playing all 8 1/2 hours of violent and graphic pornography and other DVD extras in the case against Paul F. Little of Altadena, Calif., and his company, MaxWorld Entertainment Inc. Prosecutors intended to show only a sampling.

“This is an open trial, and we felt that the court has taken that away from us,” MaxWorld attorney Louis Sirkin told the judge.

Sirkin has argued all week that the law requires jurors to view the materials in their entirety to accurately and fairly judge whether the movies are obscene.

In his films, Little goes by the name Max Hardcore. He creates scenes that show him inflicting pain and humiliation on female actors. His movies include vomiting and urination among adult women made up to look like young girls.

Bucklew denied the requests.

“The fact that you may be dissatisfied with my ruling … that’s not a reason to disqualify,” Bucklew said. “You may not be happy in the future with some of my rulings. That is still not a reason to disqualify.”

The judge denied at least three other defense motions for a mistrial later in the day.

Under cross-examination by the defense, James Komurek testified that his adult video distribution company, Jaded Video, sold the Max Hardcore films shown at trial and sent them through the U.S. mail to a Tampa post office box. Little and MaxWorld are charged with five counts of sending obscene matter through the U.S. mail.

Jurors must decide whether the films are considered obscene by local community standards. Prosecutors granted immunity to Komurek.

“So while we’re sitting here and you have immunity, your company is still shipping these products to the Tampa Bay area?” asked James Benjamin, one of Little’s defense attorneys.

Komurek responded: “The possibility exists.”

Defense attorneys then pointed to a section on Max Hardcore’s Web site that warns against viewing his material if it violates community standards.

The trial resumes on Monday.

NORCO, Calif. — Production company Spearmint Rhino Films (SRF) has announced that it will host a launch party for its newest series, “Sweat,” to take place on May 31, at the House of Blues on the Sunset Strip in Hollywood.

“This is celebrating the beginning and the release of the ‘Sweat’ series,” SRF director Dyanna Lauren said. “The series showcases the hottest sex with the best-looking people and this release party will be a blast. There’ll be drinks, live bands and lots of fun.”

TAMPA — In a surprise revelation, James F. Komurek, president and owner of JKG, Inc. and Jaded Video, testified that it was his company that mailed the five DVDs for whose interstate transport Max Hardcore is being tried.

Komurek testified that when his company, which is both a retailer and a distributor, bought videos from Max World Entertainment, as it has from almost every other adult video producer in the Los Angeles area, he assumed all control over the discs, and that Hardcore had no knowledge that Jaded Video was sending the five charged videos to the Tampa, Florida area, nor that it was using the U.S. Postal service to do so.

He also testified that he had not spoken with Hardcore regarding any portions of the country to which such DVDs should not be sent, and he confirmed that it was his company which received and deposited the postal money orders which were used by postal inspector Linda Walker to pay for the DVDs which were eventually used to charge Hardcore with interstate transportation of obscene material.

Here is my humble opinion.  Don’t hate the internet, don’t stress about the internet, just compete with it.

No matter what, Porn is an easy thing to sell.   In 2008, it’s all about how much can I sell.  If I was a store owner, I would not be trying to buy cheaper product,  (you know who I’m talking about, if it costs $2-$5, it’s gonna be crap), and then try and sell it for $59, and hope to make as much money as I can before my store closes.  Any customer can get a new release online for $22-$25.  However what I have going for myself is that Porn is a major emotional/impulse purchase, and if my customer doesn’t want to watch grainy video on an internet paysite,  who the hell wants to wait for a dvd in the mail!?!?    What I have to do as a store owner is find a way to consistantly sell new and recent releases in volume, at a decent markup, but not scare my customer into running to an internet dvd mail-order site.  Here is what I would do:

1.) Invest in new releases, and price them at roughly $29.95 (I would charge my customer only nominally for the convenience of not having to wait for the mail.

2.) Swear off cheap product that has been rehashed 1000 times, and blow out my current inventory of said product.

3.) Develop an inventory system if I don’t already have one, so I can track sales and reorders (winging this just doesn’t ever work)

4.) Stock my shelves with quality product from quality companies and continue to reorder consistently based on sales, it it doesn’t sell, blow it out for cost and don’t ever reorder (and keep a close eye on that company’s other product to see if it is stagnant as well).

5.) Communicate with my customers, find out what they like, I won’t just buy what I think will sell, I will talk to my customers and buy what THEY want!

Just start with these 5 steps and I guarantee your store will grow, prosper and profit!!

TAMPA — A federal jury will soon have the unusual task of deciding what Tampa Bay residents consider obscene, and whether a Hollywood producer’s violent pornographic films are unacceptable to the local community.

They may spend an entire day watching porn to do it.

A judge will rule today on just how much pornography will be displayed in the courtroom as prosecutors present evidence against Paul F. Little of Altadena, Calif., and his company, MaxWorld Entertainment Inc.

Little, also known as Max Hardcore, and MaxWorld are charged with five counts of using a computer server to sell obscene matter and five counts of delivering obscene matter through the U.S. mail.

Little, well-known in the pornography world, has acted in more than 130 movies, directed more than 100 and produced about 30, according to the Internet Movie Database. His films show men inflicting pain or humiliation on women. The movies have scenes that include urinating, vomiting and defecating. Adult actresses in the films are often made up to look like young girls.

Defense attorneys say that what Little and MaxWorld produce and distribute is legal and protected in the marketplace by the First Amendment.

While adult pornography isn’t illegal, it can be prosecuted as obscene under the Miller test, named for the 1973 U.S. Supreme Court case Miller vs. California.

The court developed a three-part test to determine obscenity: It must appeal to prurient interests, be patently offensive by community standards and have no literary, scientific, political or artistic value.

Jurors get to decide whether, by the contemporary standards of their community, the material in question would be deemed obscene.

Seven women and five men on the jury will speak for the bay area in this case.

To prove their case, prosecutors plan to show at least 2 1/2-hours of clips produced and directed by Little. But defense attorneys said if jurors are to fairly decide if the pornographic depictions are obscene, the law requires they see the entire movies. That could include up to 8 1/2-hours of porn on five DVDs with titles like Max Hardcore Golden Guzzlers 7 — Euro Edition and Fists of Fury 4 — Euro Edition.

U.S. District Judge Susan C. Bucklew planned to spend Tuesday evening reviewing them before she ruled.

Attorneys with the Justice Department’s Child Exploitation and Obscenity Section have flown from Washington, D.C., to try the case. The government announced its charges against Little and MaxWorld in May 2007. He is on trial in the Middle District of Florida because prosecutors purchased the DVDs from Little’s Internet Web site and had them sent to a Tampa post office box.

During jury selection, which lasted most of the day Tuesday, one woman said she literally wouldn’t be able to stomach watching hours of the type of pornography described in court. She was dismissed after saying the sight of vomit makes her physically ill.

A man who identified himself as a youth pastor was excused from the jury pool after saying he had a previous addiction to porn and didn’t want a relapse by having to view it during trial. The judge also dismissed a man who said he had four daughters, and the thought of anyone mistreating any young woman would upset him.

The 12 jurors who will decide the case include an insurance claims adjuster, a nurse, a civil engineer and a pawnshop owner.

The government is seeking forfeiture of the obscene films mentioned in the federal indictment, all gross profits from their distribution and all property used in producing the films, including Little’s home and his Internet domain names.

Court resumes at 9:30 a.m. today with opening statements. The trial may last through the start of next week.
